1. Acceptance and scope
By creating an account or using LinguExcel, you agree to these Terms of Use. If you do not agree, do not create an account or continue using the service. The version displayed when you create your account applies from that date, subject to later updates made in accordance with section 13.
When LinguExcel Membership is purchased, the Sales Terms presented before purchase also apply and prevail for payment-specific matters.
2. Service operator
LinguExcel is operated by SeanKOR, Individual entrepreneur (micro-entreprise) established in France. Contact details and hosting information are available in the Legal Center.
3. Eligibility and accounts
You must provide an email address you control and keep your credentials confidential. You are responsible for activity performed through your account. Notify LinguExcel promptly if you suspect unauthorized access.
LinguExcel does not impose a product-specific minimum age or ask for a date of birth merely to create an account. If you are not legally able to enter into these terms or provide a required consent in your country, you may use LinguExcel only with the authorization and supervision of a parent or legal guardian.
4. The learning service
LinguExcel provides sentence-based language-learning materials, audio, semantic color mapping, dictionary information, review tools, progress tracking and related educational features. Features and corpora may evolve to improve accuracy, performance and pedagogy.
LinguExcel is an educational tool, not an accredited school, examination body or guarantee of fluency. Results depend on many factors, including the learner's practice and prior knowledge.
5. Free lifetime access for eligible early users
Users who created an eligible LinguExcel account while the public early-user offer was open retain free access for life to the LinguExcel learning platform, including its decks and core learning features, without a recurring subscription charge. This entitlement is personal, non-transferable and attached to the qualifying account.
Deleting the qualifying account may permanently remove the entitlement and synchronized learning history. The entitlement does not create a right to a separate product, third-party service or individually commissioned service unless LinguExcel expressly includes it in the offer. It remains valid for as long as the LinguExcel service is operated.
6. Paid membership
Newly verified accounts receive a seven-day full-access trial without providing a payment method. When that trial ends, continued use of the learning program requires an active monthly or annual membership, unless the account already holds a separate lifetime entitlement. The public website and blog remain available without a membership.
An active membership includes the standard LinguExcel program, its five available language paths, learning content, standard features, and ordinary improvements released as part of that same product. It does not automatically include separate future products or optional features that carry material variable third-party costs, such as separately priced AI credits, API usage, or comparable metered services.
Memberships renew automatically until canceled as described in the Sales Terms. Monthly and annual billing, renewal, cancellation, and refund conditions are presented before payment.
Existing paid, manual, or recorded early-user lifetime entitlements remain valid independently. A subscription plan, price change, payment-provider change, or commercial-catalogue change will not replace, reduce, expire, or add a recurring payment requirement to those entitlements.
7. Acceptable use
You may use LinguExcel for personal learning. You must not:
- interfere with the service, its security or another user's access;
- attempt to access private systems, accounts or administrative functions without authorization;
- use automated extraction to reproduce or redistribute a substantial part of the corpora, dictionaries, mappings or audio library;
- upload unlawful, harmful or rights-infringing material;
- resell access or misrepresent an affiliation with LinguExcel.
8. Content and intellectual property
LinguExcel and its licensors retain all rights in the software, interface, brand, original educational content and supporting assets. You receive a limited, revocable, non-exclusive and non-transferable right to use the service for personal learning.
If you import or submit your own material, you retain ownership of it and grant LinguExcel only the rights technically necessary to store, process and display it to you. You are responsible for having the right to use submitted material.
9. Availability and changes
LinguExcel aims to provide a reliable service but cannot promise uninterrupted availability. Maintenance, security incidents, provider failures or product changes may temporarily affect access. Material changes that significantly affect user rights will be communicated through the website, application or account email where appropriate.
10. Suspension and termination
Access may be restricted or suspended when reasonably necessary to protect users, investigate abuse, comply with law or address a serious breach of these terms. Except where urgent action is required, LinguExcel will provide notice and a reasonable opportunity to resolve the issue.
You may stop using the service and request account deletion at any time.
11. Responsibility
Nothing in these terms excludes rights or liability that cannot lawfully be excluded. Subject to those mandatory protections, LinguExcel is not responsible for indirect losses, learning outcomes, or losses caused by events outside its reasonable control. You should keep independent copies of any material that is uniquely important to you.
12. Privacy
Personal data is handled as described in the Privacy Policy. The use of cookies and similar local technologies is described in the Cookie Policy.
13. Changes to these terms
These terms may be updated for legal, security, commercial, or product reasons. The effective date appears at the top of the document. Material changes will be notified before they take effect where required. Changes do not retroactively remove, reduce, or convert an existing paid or recorded early-user lifetime-access entitlement.
14. Law, complaints and disputes
These terms are governed by French law, without depriving consumers of mandatory protections available in their country of residence. Contact skpro@gmx.com first so a complaint can be reviewed directly.
If a written complaint submitted directly to LinguExcel does not resolve the dispute, an eligible consumer may refer the matter free of charge to Société Médiation Professionnelle, Alteritae, 5 rue Salvaing, 12000 Rodez, France: https://www.mediateur-consommation-smp.fr. Consumers also retain the right to bring a claim before a competent court.
This French consumer-mediation scheme covers eligible national disputes and cross-border disputes within the European Union. Consumers outside that scope should contact LinguExcel support for the dispute-resolution options applicable to them.
15. Force majeure and service continuity
LinguExcel is not responsible for a delay or failure to perform an obligation to the extent that performance is prevented by an event beyond its reasonable control, that could not reasonably have been foreseen when the relevant contract was formed, and whose effects could not be avoided through appropriate and reasonable measures. Such events may include, without limitation, a widespread or total interruption of the internet, telecommunications, DNS, electricity or other critical network infrastructure; war, invasion, armed conflict, terrorism or serious civil unrest; fire, flood, storm, earthquake or another natural or environmental disaster; an epidemic or pandemic; a governmental action, sanction, embargo or legal prohibition; a major cyberattack; or a widespread failure of essential hosting or cloud infrastructure, in each case only where the event satisfies all of the conditions above.
Routine maintenance, an isolated supplier incident, insufficient funds, failure to pay a provider, loss of credentials, or a loss of data that could reasonably have been prevented through appropriate security, backup or continuity measures does not by itself constitute force majeure. LinguExcel will take reasonable steps to limit the effects of a qualifying event, restore the affected service and inform users when reasonably practicable.
When the impediment is temporary, the affected obligations are suspended for its duration. When it permanently prevents continued operation, the affected contract may be terminated in accordance with applicable law. Nothing in this section excludes a mandatory consumer remedy or liability that cannot lawfully be excluded.
16. Planned discontinuation or transfer
If LinguExcel plans to discontinue the learning service permanently for a reason other than force majeure, an urgent security requirement or a legal prohibition, it will use reasonable efforts to provide at least 90 days' prior notice through the service or the account email. During that notice period, LinguExcel will use reasonable efforts to maintain access and to make any eligible user-provided content or available learning-progress data exportable in a commonly used format.
Where technically and legally feasible, LinguExcel may also provide a reduced, static, or offline continuity version of the learning materials before permanent discontinuation. LinguExcel may transfer operation of the service to a successor capable of continuing it, subject to applicable law and appropriate notice, without converting or reducing an existing recorded lifetime entitlement.
A membership supplies access for its paid term, subject to renewal and cancellation. A lifetime entitlement means access without recurring payment for the commercial life of the LinguExcel service; it is not a guarantee that an online service or any particular infrastructure provider will operate perpetually. This section does not permit arbitrary withdrawal of paid access and does not limit statutory conformity, refund, termination, or other mandatory rights.
