1. Seller and applicability
These Sales Terms apply to paid access purchased by consumers through www.linguexcel.com. Payments use Paddle, whose contracting entity identified at checkout acts as merchant of record. Paddle processes payments, calculates and remits applicable transaction taxes, and supplies payment documents under its buyer terms. The version of these Sales Terms accepted at checkout is recorded with the order.
LinguExcel does not impose a product-specific minimum age. A person without the legal capacity to subscribe must have the purchase made or expressly authorized by a parent or legal guardian.
2. Seven-day free trial
A newly verified account receives 7 consecutive days (168 hours) of access to the complete LinguExcel learning program. No payment method is required and no automatic charge occurs when the trial ends.
The trial begins when the account email is confirmed. When it expires, program access is restricted until a membership is purchased, while the account and synchronized progress are retained. The public website and blog remain free. LinguExcel may prevent repeated accounts created to obtain successive trials.
3. Membership and included service
A paid LinguExcel membership provides access to the standard LinguExcel program, its five available language paths, learning content, standard features, and ordinary improvements released as part of that same product while the membership remains active.
Membership does not automatically include a separate future product or an optional feature carrying material variable third-party costs, including separately priced AI credits, API usage, or comparable metered services. Any such exclusion will be identified before purchase or use.
Access is personal, non-transferable, and attached to the subscribing account. Technical requirements include a compatible browser or supported installed web app, an internet connection for account and synchronization services, and a valid LinguExcel account.
4. Plans, price, and taxes
The monthly plan costs US$37 per month. The annual plan costs US$247 per year. Both plans renew automatically for the same billing interval until canceled. The plan, billing interval, and next charge are displayed before payment.
Applicable transaction taxes are included in the displayed USD price. Where local-currency presentation is available, checkout displays the amount and conversion information before payment. A bank or card issuer may apply separate charges that LinguExcel does not control.
Price changes apply no earlier than the next renewal after legally required notice. Customers may cancel before that renewal if they do not accept the new price. A price change never converts, reduces, or expires a separately recorded lifetime entitlement.
5. Order and payment
Checkout summarizes the selected plan, recurring price, billing interval, tax treatment, renewal, cancellation, and refund information before the customer confirms an unambiguous obligation to pay. No optional paid item is added through a preselected choice.
LinguExcel activates paid access only after receiving confirmed server-side information through a signed Paddle notification, not merely because a browser reaches a success page. The statement descriptor is LINGUEXCEL; a card statement may also include Paddle's name.
6. Renewal, failed payments, and access
Paddle charges the selected payment method at each renewal. If a renewal payment fails, Paddle may retry it and request updated payment details. Access may remain temporarily available while the subscription is past due, but may be restricted if payment cannot be collected.
A failed initial payment does not create paid access. If a confirmed payment is later refunded, reversed, or successfully disputed, the corresponding subscription access may be withdrawn without affecting mandatory consumer rights or any separate lifetime entitlement.
7. Cancellation
A membership may be canceled online at any time from the account billing link and Paddle's customer portal. Cancellation normally takes effect at the end of the current paid billing period. Access continues until that date and no further renewal is charged.
Canceling stops future renewals but does not itself refund a payment already made. The voluntary guarantee and mandatory consumer rights described below remain available independently.
8. Thirty-day money-back guarantee
The purchaser may request a full refund within 30 calendar days after the first subscription payment, without providing a reason. The request may be sent to skpro@gmx.com from the account email and must include only the information reasonably necessary to identify the purchase.
This voluntary guarantee is available once per person on the first subscription payment. It does not restart on renewal, plan change, repurchase, or use of another account or payment method. A full refund ends the corresponding paid membership. This limit does not restrict statutory withdrawal, conformity, or other mandatory consumer rights.
9. Statutory withdrawal rights
Consumers who purchase at a distance benefit from the statutory withdrawal rights applicable to their contract, including a 14-day period where it applies. Immediate program access begins at the purchaser's request after payment. The voluntary 30-day full-refund guarantee is more favorable and remains available regardless of use during that period.
Optional model notice: “I hereby give notice that I withdraw from my LinguExcel membership, ordered on [date], for the account [email]. Name: [name]. Date: [date].” It may be sent to skpro@gmx.com. A refund request under the 30-day guarantee may be made by email without using this wording.
10. Digital-service conformity
Consumers benefit from the mandatory legal guarantee of conformity for digital services. LinguExcel will provide a service conforming to the contract and the updates necessary to maintain that conformity during the period for which the service is supplied. These rights cannot be excluded or reduced by these Sales Terms or the voluntary refund guarantee.
11. Existing lifetime entitlements
Accounts holding a recorded early-user, paid, or manually granted lifetime entitlement do not need a subscription for the access covered by that entitlement. Introducing recurring plans, changing payment processors, or changing the commercial catalogue will not replace, reduce, expire, or add a recurring charge to that entitlement.
12. Support and complaints
Billing and service questions can be sent to skpro@gmx.com. LinguExcel aims to respond within two business days, excluding public holidays. This is a service target rather than a guaranteed resolution time.
If a written complaint submitted directly to LinguExcel does not resolve the dispute, an eligible consumer may refer the matter free of charge to Société Médiation Professionnelle, Alteritae, 5 rue Salvaing, 12000 Rodez, France: https://www.mediateur-consommation-smp.fr.
This French consumer-mediation scheme covers eligible national disputes and cross-border disputes within the European Union. Consumers outside that scope should contact LinguExcel support for the dispute-resolution options applicable to them.
13. Applicable law
French law applies without depriving consumers of mandatory protections available under the law of their country of residence. Any unresolved dispute may be submitted to the appointed consumer mediator or a competent court.
14. Force majeure and service continuity
Performance may be suspended where prevented by an event beyond LinguExcel's reasonable control that could not reasonably have been foreseen and whose effects could not be avoided through appropriate measures. This may include, without limitation, a widespread interruption of the internet, telecommunications, DNS, electricity, or critical infrastructure; war, armed conflict, terrorism, or serious civil unrest; a natural or environmental disaster; an epidemic or pandemic; governmental action, sanctions, embargoes, or legal prohibitions; a major cyberattack; or a widespread failure of essential hosting or cloud infrastructure, but only where the event satisfies those legal conditions.
LinguExcel will take reasonable steps to mitigate the event and restore service. A routine or reasonably avoidable provider, payment, credential, security, or backup failure does not by itself qualify. A temporary impediment suspends affected obligations; a permanent impediment may result in termination in accordance with applicable law. These provisions do not exclude mandatory consumer remedies.
